These Disclaimers (this “Disclaimers Agreement”) is a legal agreement between you (“you”) and Lyquid, Inc., a Colorado corporation (“Company,” “we” or “us” or ”our”) for use of Mimzy, the website (mimzy.app), the servers used by the application, the computer files stored on such servers, and all related services, features and content offered by the Company (collectively, the “App” or “Mimzy”). This Disclaimer Agreement is not concluded with Google, Inc., any of its subsidiaries, or any other entity as may apply.

Consult your healthcare provider before you use this product if you are unsure of its ability to help you succeed in the Mimzy Program, as well as if you have any medical concerns relating to Mimzy or the Mimzy Program in general.

Lyquid, Inc. is:

• NOT a consultant to you.
• NOT medically treating you.
• NOT offering you ANY medical advice or guidance.
• NOT responsible for your health, nor your voluntary adoption and usage of Mimzy as selected and recommended by your healthcare provider.
• NOT responsible for your success or failure in using Mimzy.
• The developer, supplier and creator of Mimzy, a Google Sheets toolset built to support you and your healthcare provider’s efforts in the success of your personal (and voluntary) Mimzy Program.

Medical services disclaimer

It is important to note that Mimzy and mimzy.app by Lyquid, Inc. is not intended to diagnose or treat any medical condition and should not be relied on for any medical purposes. It is intended to provide you information and ease of use in managing your Mimzy Program as assigned to you by your healthcare provider. Always work directly with your healthcare provider for personal guidance for your health and wellbeing. If you have any concerns about your health, please talk to your healthcare provider.

THE COMPANY IS NOT A LICENSED MEDICAL CARE PROVIDER AND THE APP IS NOT INTENDED TO REPLACE PROFESSIONAL MEDICAL ADVICE OR DIAGNOSE, TREAT OR MANAGE ANY ILLNESS OR MEDICAL CONDITION. PLEASE CONSULT WITH A LICENSED PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER BEFORE MAKING ANY DECISIONS OR TAKING ANY ACTIONS THAT MAY AFFECT YOUR HEALTH AND SAFETY OR THAT OF YOUR FAMILY. WE DISCLAIM LIABILITY FOR ANY ERRORS OR OMISSIONS, OR FOR UNINTENDED TECHNICAL INACCURACIES, OR TYPOGRAPHICAL ERRORS IN THE PROVIDED MATERIALS, AS WELL AS VIOLATION OF ANY ETHICAL OR MORAL STANDARDS APPLICABLE IN YOUR COMMUNITY TO HEALTH EDUCATION AND RELATED MATERIALS.​

Our goal is to help make certain health-related information more readily available and useful to you. However, the App cannot and does not guarantee health-related improvements or outcomes. Your use of the App and any information, predictions, or suggestions provided in the App are at your sole risk. We make no representation or warranty of any kind as to the accuracy of data, information, estimates, and predictions that we may provide to you through the App and you agree and understand that the App is not intended to match or serve the same purpose as a medical or scientific device.

If you choose to share your personal Mimzy Client File with your healthcare provider, you are doing so intentionally and adhere to the Privacy practices of your healthcare provider. We are not liable for any misuse of your personal information as used by your healthcare provider or any third party that accesses your Mimzy Client File. You may at any time revoke your healthcare provider’s access to your personal Mimzy Client File by following the instructional steps as explained within our Knowledge Base Tutorials located at: https://help.mimzy.app 

Warranty disclaimer

The Company (and Google) controls and operates the App from various locations and makes no representation that the App is appropriate or available for use in all locations. The App or certain features of it may not be available in your location or may vary across locations.

THE APP IS PROVIDED “AS IS”, “AS AVAILABLE” AND IS PROVIDED WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED, SAVE TO THE EXTENT REQUIRED BY LAW. THE COMPANY, AND ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS, PARTNERS AND CONTENT PROVIDERS DO NOT WARRANT THAT: (A) THE APP WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THE RESULTS OF USING THE APP WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE APP IS SOLELY AT YOUR OWN RISK; OR, (E) THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE CONTENT, TEXT, IMAGES, SOFTWARE, GRAPHICS, OR COMMUNICATIONS PROVIDED BY THIRD PARTIES ON OR THROUGH THE APP, INCLUDING IN SECRET CHATS. SOME STATES / COUNTRIES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Use of mobile devices

Please note that your carrier’s normal rates and fees, such as text messaging and data charges, will still apply if you are using the App on a mobile or tablet device.

Miscellaneous

“Easy to use” is a subjective claim based on our and your individual interpretation and competence in using the Google Sheets technology and Mimzy’s developed features.

“Available on any device” requires that you own a free Google account and that your device is compatible and functional with the Google Sheets app.

Google Sheets Service: We are not liable for any outages within the Google ecosystem, especially the Google Sheets service and availability.

Information on our website and throughout Mimzy is for educational purposes only. Our website and Mimzy is not intended to be a substitute for professional medical guidance. You should always consult your health care provider with any questions you have regarding your medical conditions.
